Design

Our websites are built on WordPress Platform using Divi Framework builder. WebScape uses premade layouts that are developed by an experienced web designer from the Divi Community. There are over 900+ industry-specific page layouts to browse through. All themed layouts come with a creative direction (colour palette, industry theme and specific features) You will have plenty of opportunities to review my work and provide feedback by either email or phone. I will share a link to your website draft, where you can at any time review current work. If at any stage you change your mind about what you want delivered or you are not happy with the direction our work is taking, you forfit any deposits made and your contract will be terminated.

Website Content

WebScape is not responsible for creating content on your any pages of your website. You will notice content that repeats or in foregin lauguage, this is “dummy text” you are required to fill the area with your content, keeping the same word count. Writing web content is tricky and trust me there a method to it and keyword placement. I encourage customers to do a Google Search on Keyword planner and learn how to find high ranking keywords to use in your content creation. We can provide a third party for professional copywriting and editing services if you require content creation. WebScape can provide for you a separate estimate.

Logo

Logo must be supplied in a editable format perferably .png or .psd file OR jpg or pdf file. Images must be supplied in a high-resolution digital format. To alter any logo files is $99. Logo creation is offered through WebScape starting from $299.

Imagery

Any photographs supplied to WebScape MUST be 100% owned by you. WebScape has stock websites that you can browse to find suitable images. Any images supplied by WebScape are charged at 7.95each including any premade layouts. If you choose to buy stock photographs, we can suggest stock libraries. If you would like me to search for photographs for you, of more than 5+ images I can provide a separate estimate. All images, graphics or documents supplied to WebScape we be delete and removed from computer upon website completion, it is your responsibility to keep all copies of website imagery..

Responsive Design for Browsers

All our websites are responsive design ensuring that a person’s experience on the website is appropriate to the capabilities of a device. We test our designs on IOS and Android devices, tablets and laptops. We work in current versions of major desktop browsers and test on those made by Apple (Safari), Google (Chrome), Microsoft (Edge), Mozilla Firefox and Opera. Internet Explorer is no longer a trusted brower. We won’t test in older browsers unless we agreed separately. If you need an enhanced design for an older browser, we can provide a separate estimate.

Technical support

WebScape offers email and phone support for all our website and web hosting customers. Depending on your issue it may be covered under monthly maintenance package or web hosting package with WebScape, all other issues will be charged at hourly rate of $65.

Web Hosting, Emails & SSL Certificates

We host your website annually for $220, our Medium Business Website Package and Ecommerce Package offer your first year off hosting for free in a 3-year fixed term plan. Our servers are based in Sydney and Melbourne and Singapore. Up to 5 Email addresses come with your host package. Email configuration on customers computer is charged separately. Secure Sockets Layer (SSL) Certificates encrypts data to send information securely across the internet and browsers. To know any site is secure a green padlock will be visible in the address bar. SSL can be purchased separately for $29.00.

Domain Registration

Customers are required to purchase a domain name; you will need your ABN details to complete purchase. The domain name is owned by you and is your responsibility to keep it registered and active. It is recommend to pay to have your domain private about $10/year, to avoid your details being public telemarketers and avoid spam emails.

Search engine optimisation (SEO)

SEO is offered in our Small and Medium website packages. We do not guarantee improvements to your website’s search engine ranking, but the pages that we develop are accessible to search engines and optisimised to web standards. SEO includdes meta descripition, image optisimisation, image alt tags, title tags, keyword research. SEO is charged at $99 page and eCommerce site are charged per product amount. Ongoing SEO management is offered through Blossom & Grow SEO at $220 month.

Backup to Cloud

As part of the building process all work is done in stages and to avoid loosing any work on your website. I send a hard copy of your site to a cloud either Dropbox, Google Drive, Onedrive etc. This backup will run regularly after website build is complete, with regular updates to Core WordPress files, theme files or plugins you can encounter issues that can break your website. Having this backup not on your hosting server I can guarantees any website breaks or malicious attacks to your site can be restored with one-click from the cloud backup. I will require you to sign into your cloud account from my computer to connect require service.

Google Console Setup

All domains are required to be verified by Google and all websites are connected to your Google Account which links Google Search Console, Google Analytics and Google MyBusiness* to your website. All customers must sign in to my computer with your Google Account to allow these features to be connected. Please be advised this is compulsory setup to be notice on search engines and verfiy your domain online. If you do not have an account you can use any email to setup a Google Account (Gmail Account). *Setup of Google MyBusiness Listing is offered to customers for additional $149 setup

Legal

We will carry out our work in accordance with good industry practice and at the standard expected from a suitably qualified person with relevant experience. That said, we cannot guarantee that our work will be error-free and so we cannot be liable to you or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if you have advised us of them.
Your liability to us will also be limited to the amount of fees payable under this
contract and you won’t be liable to us or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if we have advised you of them.
Finally, if any provision of this contract shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this contract and shall not affect the validity and enforceability of any remaining provisions.

Intellectual property rights*
First, you guarantee that all elements of text, images or other artwork you provide are either owned by yourselves, or that you have permission to use them. When you provide text, images or other artwork to us, you agree to protect us from any claim by a third party that we are using their intellectual property.
We guarantee that all elements of the work we deliver to you are either owned by us or we have obtained permission to provide them to you.

Provided you have paid for the work and that this contract hasn’t been terminated, we will assign all intellectual property rights to you as follows:
You will own the website I design for you plus the visual elements that we create for it. A copy of your website files will be sent to your preferred cloud app, you should keep them somewhere safe as we are not required to keep a copy. You own all intellectual property rights of text, images, site specification and data you provided, unless someone else owns them. We will own any intellectual property rights we have developed prior to, or developed separately from this project and not paid for by you.

Design Proposal

Once final design is approved, changes to website build will be charged at $40/hr

Displaying my Work

I love to show off my work, I reserve the right to display all aspects of our creative work, including sketches, work-in-progress designs and the completed project on our portfolio pages and in posts on social media, website forums, in magazine articles or in books.

Website Up-keep

Web Maintenance is highly recommended to keep your website functionally correctly and safe from malicious attacks. Hackers look for vulverable website with no security, out dated files and themes to find backdoors to steal information and corrupt your files. If you have no backup you stand to lose your entire site. It is compulsory for all eCommerce website to have a maintenance package; your website holds your customers personal and credit card details and should be updated every other day or when required updates are released. We do not provide continual management of your Google Analytics, Google MyBusiness Listing or SEO account.

Payment schedule

We are sure you understand how important it is as a small business that you pay the invoices that we send you promptly. As we are also sure you will want to stay friends, you abide by the following payment schedule.
A deposited amount of 40% of the total agreed outlay is to be paid before work will commence.
We issue invoices electronically. Our payment terms are 7 days from the date of invoice by bank transfer. All proposals are quoted in Australian dollar and payments will be made at the equivalent conversion rate at the date the transfer is made.
You agree to pay all charges associated with international transfers of funds. The appropriate bank account details will be printed on our electronic invoice. We reserve the right to charge interest on all overdue debts at the rate of 7% per month or part of a month. A secondary payment of 20% of final amount is required once first draft of all pages are created. The period to build your website is 8 weeks, it is customer responsibility to have content & images for website ready at beginning of build to avoid delays. After 8 weeks your websiite will be handed over on payment at current build process. If you wish to complete website you will be charged remaining cost to complete website.

But where’s all the horrible small print?
Just like a parking ticket, neither of us can transfer this contract to anyone else without the other’s permission.
We both agree that we will adhere to all relevant laws and regulations in relation to our activities under this contract and not cause the other to breach any relevant laws or regulations.
This contract stays in place and can not be renewed. If for some reason one part of this contract becomes invalid or unenforceable, the remaining parts of it remain in place.
Although the language is simple, the intentions are serious and this contract is a legal document under exclusive jurisdiction exercised by Australian courts

* Just to be clear, “Intellectual property rights” means all patents, rights to inventions, copyright (including rights in software) and related rights, trademarks, service marks, get up and trade names, internet domain names, rights to goodwill or to sue for passing off, rights in designs, database rights, rights in confidential information (including know-how) and any other intellectual property rights, in each case whether registered or unregistered and including all applications (or rights to apply) for, and renewals or extensions of, such rights and all similar or equivalent rights or forms of protection which subsist or shall subsist now or in the future in any part of the world.
